Practical Alternatives to High-Cost, High-Stress Litigation

More and more over the last twenty years, divorcing parties have looked for ways to avoid the costly, time-consuming, and often harmful aspects of litigation during divorce. Mediation has become one of the most popular means of alternative dispute resolution for divorcing spouses who do not want to resolve their divorce issues through the process of litigation.

From Susan's interview for the Masters of Family Law series on ReelLawyers.com.

The concept of alternative dispute resolution was created to refer to options other than the most widely recognized process of going through the court system and accompanying procedures (called litigation). Alternative dispute resolution includes:

  • Mediation
  • Collaborative Law
  • Arbitration
  • Early Neutral Evaluation
  • Special Magistrates

Consistent with the mission of the Gallagher Law Office, L.L.C. to keep the financial and emotional cost of divorce to a minimum, we meet the growing demand for alternative dispute resolution and offer clients throughout the Twin Cities our mediation services.

Alternative dispute resolution approaches such as mediation and Early Neutral Evaluation offer clients a cooperative method to dealing with the difficult decisions related to divorce, including child custody and support, property division, and spousal maintenance.

These approaches allow parties to come together with the goals of:

  • Providing more control to both parties
  • Enabling communication
  • Focusing on the best interests of children, families, and everyone involved
  • Avoiding the burdens and expense of traditional divorce litigation

In the mediation process, we assist clients throughout the process, working with both parties to facilitate communication, provide information, and offer a productive atmosphere in which the parties can reach their own agreement. In Minnesota, divorce mediation services are available to most individuals, but may not be appropriate for every family. For example, in cases where there is a basis to believe that a spouse or child has been abused, mediation may not be appropriate.

Contact the Gallagher Law Office, L.L.C. today if you are interested in finding a way to resolve the disputes affecting your life through mediation or one of the other processes of alternative dispute resolution. We can explain the advantages of alternative dispute resolution and help you begin the process as soon as possible.
